“INSTANT DRAWS - Trophées SNCF 2019” Game RULES

Article 1. Organising company

SNCF, a public industrial and commercial undertaking, registered in the Bobigny Trade and Companies Register under number no. 808.332.670, head-quartered at 2 place aux Étoiles, 93200 Saint-Denis, (hereinafter referred to as the “Organising company”), represented by Mrs Marie-Cécile Desormière in her capacity of Director of Internal Communications, duly authorised to this effect, is operating, on the trophees.sncf.com website (hereinafter referred to as the “Website”), a free game without obligation to purchase entitled “Instant Draws - Trophées SNCF 2019” (“Instants Gagnants - Trophées SNCF 2019”) (hereinafter referred to as the “Game”) in the broader context of the Trophées SNCF 2019 competition. The Game is open to all employees of the SNCF Group, including those of the three ÉPICs and subsidiaries (hereinafter referred to as “SNCF”).

Article 2. GAME TIMETABLE

The Game will be open to entrants from 10 AM on 13 May 2019 until 11:59 PM on 29 May 2019.

Article 3. Conditions for taking part

3.1. Conditions for participants

Taking part in the Game implies and entails unreserved acceptance of the Rules in their entirety, together with the rules of conduct in force on the Internet. Non-compliance with these conditions will result in the disqualification of the Participant concerned.
The first time a user clicks on the "Vote now" or "See successful projects" tabs when they log on, they are asked to accept the rules of the "Instant Draws" game. If they do not agree to the rules, the User will not be able to access the voting area

A participant (hereinafter referred to as the "Participant" or the "Participants") is:

  • any employee of the SNCF group, including the three ÉPICs and subsidiaries aged 18 or over on the date on which the Game begins (hereinafter referred to as the "Participant" or the "Participants")
  • The game is only open to Users logged onto the Website.
  • The game is only open to participants who have voted for all five categories.

Participation in the Game is limited to one entry per Participant.

Participation in the Game is forbidden to staff members of the Organising company who have played a direct part in the creation, organisation, promotion or publishing of the Game, together with members of their families (spouses, partners, ascendants, descendants or siblings).

Entering using a false identity or that of another person, communicating false information and/or entering under several identities will result in the disqualification of the Participant concerned.

3.2. Conditions pertaining to methods for participating AND SELECTING THE WINNERS

The Game involves an instant draw among Participants who have voted in each of the six categories of successful projects.

To take part in the online Game, participants must:

  • visit and log on to the Website;
  • click on the “Vote now” or “View the successful projects” tabs;
  • vote in each of the six categories;
  • scratch the “Scratch here” box in the pop-up window that opens automatically once the sixth (and final) vote has been cast.

Participants will know immediately whether they have won or lost once they have scratched the “Scratch here” box. If they have won, a pop-up window will appear in which they must provide their personal contact details in order to be able to receive their prize.

The “instant draws” are predetermined throughout the period of the Game in the form of dates, hours and minutes spaced at regular intervals. If a Participant plays at one of these specific times, they win the prize. If nobody plays at that exact time, the prize will be awarded to the first player thereafter. The list of “instant draws” has been lodged with Maître Valérie Guilleminot, Bailiff, of 13 rue de Montyon, 75009 Paris, but may not be consulted by the players.

Article 4. Prizes

The following prize shall be awarded to each Winner:

  • one 4GB USB key.
    The unit value of this product is €11.88 incl. VAT (eleven euros and eighty-eight centimes including VAT).

The 300 (three hundred) prizes.

The values specified above are given as a guide only and are subject to variation.

Each prize shall be dispatched to the address provided by the Winner, within three months of the Game ending.
Users are therefore responsible for the accuracy of the personal address information that they provide so that the organising company can send their prize. In the event winners making any mistakes when entering their addresses, under no circumstances may the organising company be held liable in the event of their not receiving their prize.

The prizes are non-transferable and may not be transferred or sold to any third party. The prizes shall not be contested and shall not be subject any reimbursement or compensation of any type whatsoever.

The Organising company reserves the right to substitute the prizes mentioned above for items of an equivalent nature and value if exceptional circumstances so demand.

The Organising company cannot be held liable for the prizes it awards to Winners in the Game, particularly in the event of a prize not working or of any harmful consequence suffered by a Winner or any third party due to the use of such prizes.

Article 5. NOTIFICATION OF WINNERS and awarding of prizes

The Organising company reserves the right to carry out any necessary checks on the Winners' identity and the veracity of the information that they provided when they entered and submitted their personal addresses.
Once the Winner's compliance with the conditions for taking part has been checked, they shall be notified of their winnings by email at the address they provided when they entered the Game, within no more than 30 days of the Game ending.

Each prize shall be sent by standard mail to the address provided by the Winner, within three months (3) of the Game ending.

If the prizes delivered are not received by the addressee and are returned to the sender, they shall remain the exclusive property of the Organising company.

The Organising company shall not be liable for any delay, loss, theft or damage to prizes dispatched and the Winner renounces any claim that may relate to such an event.

It is specifically stipulated that under no circumstances may the Winner request reimbursement of additional costs relating to the delivery or use of the prize awarded.

ARTICLE 6. INTELLECTUAL PROPERTY

The Organising company owns all the intellectual property rights regarding the Website's structure and content (text, trademarks, logos, photographs, images, graphics, sound components, software, icons, layout and database) or has legally acquired the rights allowing the unrestricted use of the Website's all structure and content, conditional upon the specific management of contributions by the Participants.

Participants may not reproduce, represent, adapt, modify and/or use, in any way whatsoever and for any purpose whatsoever, part or all of the Website's structure or content.

Non-compliance with these provisions may constitute an act of forgery and/or unfair competition incurring the civil and/or criminal liability of its perpetrator.

Article 7. Liability

Taking part in the Game implies knowledge and acceptance of the characteristics and limitations of the Internet, the absence of means to protect some data against possible misappropriation or piracy and the risk of contamination by any virus on the network. Each Participant is therefore responsible for taking whatever measures are necessary to protect their own data.

The Organising company is not liable in the event of the Internet or intranet network not working properly, thus preventing access to the Game or the smooth running thereof.

In the event of a computer virus, external attack, fraud or technical failure, the Organising company reserves the right to cancel or amend the terms of the Game's rules without being liable or accountable to the Participants in any manner. In this event, the Organising company reserves the right not to award prizes and/or to take legal action against the perpetrators and/or accomplices involved in these fraudulent activities.

The Organising company shall not be held liable if compliance with these Rules is delayed or prevented due to a case of force majeure or unforeseeable circumstances.

Force majeure is understood as meaning any event external to the party affected that is unforeseeable, irresistible and insurmountable, that prevents one or other party from executing some or all of the obligations for which it is responsible under the terms and conditions of the Rules. A case of force majeure may take the form, amongst other instances, of social conflicts, the intervention of civil or military authorities, natural disasters, fires, water damage, and the poor operation of or disruption to the telecommunications or electricity networks.

In all cases, the Organising company must do everything in its power to limit the duration and effects of the unforeseeable circumstances or force majeure.

The Organising company reserves the right to cancel, shorten, suspend, postpone or modify the Game without notice if exceptional circumstances so demand. In any event, it shall not be held liable in this respect.

Article 8. Reimbursement of participation costs

The Game, which is free and without obligation to purchase goods or services, is open to all employees of the SNCF Group, including the three ÉPICs and subsidiaries.

Participation in the Game by means of a fixed or mobile Internet connection provided either free of charge or on a flat-rate basis (cable, ADSL, fibre optics, mobile Internet package) shall not result in any reimbursement insofar as the Participant visiting the website in order to take part in the Game does not incur any additional cost.

Article 9. Information technology and data protection

Personal data collected within the context of the “Instant Draws - Trophées SNCF 2019” Game is collected by the Organising company and is processed for the purposes of managing participation in the Game, identifying the Winners and distributing the prizes.

In order to be able to validate entries and take them into account, all data preceded by an asterisk is mandatory. Participants are therefore notified that their entry will not be approved if they prevent this information from being collected.

The data shall only be retained for the period required for the purposes given above, i.e. until 1 July 2019.

The parties who shall receive personal data are members of the Trophées SNCF 2019 organising company in the Group Communications and Image Department.

In accordance with the provisions of the French Data Protection Act No. 78-17 of 6 January 1978, Participants have a right to access, correct and if necessary, oppose, the processing of information about them.

As such, any person with adequate proof of identity may exercise their rights by sending their request to:

The data collected is for the exclusive use of the Organising company's Internal Communications Department. In any event it shall not be communicated or passed on to any third parties.

Article 10. Submitting / changing the Rules

The Game Rules have been submitted to Maître Valérie Guilleminot, Bailiff, of 13 rue de Montyon, 75009 Paris.

The Game Rules may be consulted free of charge online and throughout the period of the Game at the following address: https://trophees.sncf.com

The Game Rules may be changed at any time by the Organising company by means of an amendment in accordance with mandatory legal requirements, and published by online notice on the Website.
Should any significant changes be made to all or part of the Game Rules, a pop-up window will be displayed providing information about the changes in the Game Rules. The Participant will be required to accept the modified Game Rules.

Article 11. Disputes

The Rules are subject to French law.

Any disputes or complaints pertaining to the Game must be made in writing and sent to the following address:

No disputes or complaints shall be taken into consideration if they are received more than two months after the end of the Game.

Any dispute that cannot be settled amicably shall be referred to the competent courts in Paris.
